This Privacy Policy describes how Global AI Platform Corporation, along with our subsidiaries and affiliates (collectively referred to as “GAP”, “we”, “us” or “our”), processes information from and about you when you use our products, websites and services, or interact with us (collectively, the “Services”). By using the Services, you agree to the terms and conditions of this Privacy Policy (“Privacy Policy”).
“Personal Information” means any information relating to an identified or identifiable individual.
Information We Collect
In most cases, we collect Personal Information directly from you. However, we may also obtain Personal Information about you from third parties or automatically when you interact with our Services.
Where applicable, we indicate whether and why you must provide us with your Personal Information. If you do not provide Personal Information when requested, you may not be able to benefit from the Services if that information is necessary to provide such Services or if we are legally required to collect it.
Below is a description of the different types of Personal Information we process and the sources from which we obtain them:
- Customers. If you are our customer, we collect your name, contact information, payment information, transaction history, and any other information you provide to us. The type of information we collect depends on the type of transaction we have with you.
- Account Information: When you create an account with us, we collect information associated with your account, including your name, contact information, account credentials, payment information, and transaction history.
- Prompts and Outputs: Our Services allow you to submit text, documents, or other materials to our Services (“Prompts”), which generate responses based on your Prompts (“Outputs”). If you include Personal Information in your Prompts, we collect that information and that information may be reproduced in the Outputs. Prompts and Outputs are subject to our Data Retention terms below.
- Events and Surveys. We collect Personal Information about you if you choose to register for an event sponsored by us or respond to a survey. This Personal Information may include your name, address, title, company, phone number, and email address, as well as specific information relevant to the event for which you are registering or survey you are responding to.
- Communications. If you choose to contact us for any purpose, we will collect your contact details, your name, and the content, date and time of your message, as well as our reply and any follow up action we take in relation to your inquiry.
- Business Partners and Vendors. We may receive contact details and payment information from business partners’ and vendors’ employees in furtherance of the relevant partner or vendor relationship.
- Log Data. When you use our Services, we receive certain technical data about your visit or use that includes information that your browser or device automatically sends when you use our Services (“Log Data”). Log Data includes your Internet Protocol address, browser type and settings, the date and time of your request, standard server log information, and how you interact with our Services.
- Other Sources. We may receive Personal Information about you from other sources, including third parties that help us update, expand, and analyze our records, identify new customers, or prevent or detect fraud.
- Do Not Track. Some web browsers provide a “Do Not Track” option. GAP does not respond to browser “Do Not Track” signals.
Use and Disclosure of Personal Information
We may use your Personal Information for the follow purposes:
- To perform a contract with you (e.g. processing payment, Prompts, and providing Outputs).
- Where it is necessary for our legitimate interests, such as: to facilitate purchases of our products and services; improve, develop, and/or provide new products, services, and features; enforce our terms; respond to your requests; protect your, our or others’ rights, property, or safety; prevent fraud and abuse; for marketing purposes; to manage our business relationships with customers, vendors and suppliers, distributors, marketing and research agencies, business partners, and other contractors; and otherwise provide services to you.
- To communicate with you and respond to your inquiries.
- For other business purposes necessary to comply with laws, law enforcement requests, and legal process, such as a court order or subpoena.
We may also disclose Personal Information about you as described below:
- With vendors and service providers who perform services on our behalf, including dealers, distributors, marketing and research agencies, with whom GAP has a direct contractual relationship.
- With GAP affiliates, subsidiaries, offices and representatives around the world as needed to provide our Services.
- With third party contractors engaged by GAP in the course of business (e.g., accountants, insurance companies, banks, auditors, and other consultants).
- In case of merger, sale, or other asset transfers. If we are involved in a merger, acquisition, financing, due diligence, reorganization, bankruptcy or liquidation where the business will not continue as a going concern, receivership, sale of GAP assets, or transition of our products or services to another person or entity (“Transactions”), then your Personal Information may be transferred as part of such a transaction as permitted by law and/or contract.
- If you gave us your permission.
- If we believe doing so is required or appropriate to (i) comply with laws, law enforcement requests, and legal process, such as a court order or subpoena; (ii) respond to your requests; or (iii) protect your, our or others’ rights, property, or safety.
- With government agencies, regulators or courts, as required by applicable law.
- As necessary to provide Services to you.
- With event partners or co-sponsors.
User Access and Control
If you would like to access, review, correct, update, suppress, delete, or otherwise limit our use of your Personal Information you have previously provided directly to us, you may contact us as outlined at the end of this Privacy Policy. In your request, please include your email address, name, address, and telephone number and specify clearly what information you would like to access, change, update, suppress, or delete. We will try to comply with your request as soon as reasonably practicable and consistent with applicable law. Note that subject to applicable law, in some cases we may not comply with your request where we may require your information in order to comply with applicable law, or to protect, enforce or defend our rights or employee rights, or those of an Affiliate.
Aggregated or De-Identified Information
We may process your Personal Information in an aggregated or de-identified form for the purposes of analyzing the effectiveness of our Services, conducting research, analyzing the behavior of users of our Services and training our models and interfaces. Usually, we only do so under your authorization (where you act as the “controller” for any personal data contained in Prompts and Outputs).
Data Retention
We take measures to delete your Personal Information or keep it in a form that does not permit identifying you when this information is no longer necessary for the purposes for which we process it, unless we are required by law to keep this information for a longer period. When determining the retention period, we take into account various criteria, such as mandatory retention periods provided by law and the statute of limitations, the type of Services requested by or provided to you, the possible re-enrolment by you with our Services, and the impact on our Services if we delete some information from or about you.
Security
We maintain administrative, technical and physical safeguards that are intended to appropriately protect Personal Information against accidental or unlawful destruction, accidental loss, unauthorized alteration, unauthorized disclosure or access, misuse, and any other unlawful form of processing of the Personal Information in our possession. However, because no information system can be 100% secure, we cannot guarantee the absolute security of your information.
International Data Transfers
GAP is an international organization with offices worldwide. Your Personal Information may be transferred to countries that do not have the same data protection laws as the country in which you initially provided the information.
If you are located in the European Economic Area, we rely on contracts approved by the European Commission to transfer your Personal Information to our offices around the globe. In addition, we may transfer your Personal Information:
- To countries that have been deemed to provide an adequate level of protection of Personal Information by the European Commission
- To partners and vendors by relying on contracts approved by the European Commission
- To U.S. based partners and vendors certified under the EU-U.S. Privacy Shield framework
